在联邦最高法院任职的沃伦（Earl Warren）大法官。他本人曾经
以保守的共和党人的身份担任加利福尼亚州的州长，后来由
共和党总统艾森豪威尔任命为最高法院首席大法官。但是上
任之后，沃伦大法官在民权和被告人权利等问题上都明显地
倾向于自由派的观点，因此让任命他的总统大失所望。艾森
豪威尔后来承认，对沃伦的任命是他“作为总统所犯下的最
为愚蠢的错误”。
（3）社会地位与高薪养廉

三、相关知识
美国宪法通过于1787 年，生效于1783 年，是世界土制
定最早且适用时间最长的成文宪法，也是人类历史上最重要
的法律文件之一。它用三权分立制取代了封建君主的个人集
权专制，确立了资产阶级共和制的政体，捍卫了美国资产阶
级革命的成果，并成为世界资产阶级革命的一面旗帜。对美
国自身而言，该部宪法使其由松散的邦联制过渡为统一的联
邦制，加快了美利坚民族的融合和进步，推动了美国经济与
国会的发展，为美国成为世界头号强国奠定了政治、法律基
础。该部宪法最初只有7 条，后来又补充了一系列修正案。
至今，这部法律仍然是美国赖以生存和发展的基本法，是其
最高法律。

美国实行联邦制，是由美洲的殖民史所决定的，旨在“使中
央权力处于适当的最高地位，同时并不排除地方的权力”。美
国联邦制度不仅对美国国家发展发挥了巨大的作用，也是对
世界政治文化的一个重大贡献。
